Own Your Name: A Founder's Guide to Trademarks, Copyright and Patents in Qatar
- بواسطة Falak
A startup's most valuable assets are often things nobody has registered: the brand customers recognise, the code the product runs on, the process that makes it hard to copy. Investors look closely at these in due diligence, and a gap such as a brand someone else filed first or code written by a contractor who never signed it over can delay a round or lower a valuation. Qatar's system for protecting all three is now largely online and affordable for a young company. This guide covers trademarks, copyright and patents in that order, with the steps, costs and the mistakes founders most often make.
This article is general information, not legal advice. Fees and procedures change; confirm current requirements with the Ministry of Commerce and Industry (MOCI) or a registered IP agent before you file.
MOCI's Intellectual Property Rights Protection Department runs trademark registration through the ministry's online services platform. MOCI's published guidance describes the application: log in or create an account, choose the Trademark Registration Service, enter applicant details (directly or through a legal representative), enter the mark, the goods or services it covers and its class, add any priority claim, upload documents and submit. Required documents are the commercial registration for a company, a power of attorney if you use a representative, personal ID for individuals and a JPEG image of the mark. The platform calculates fees and you pay online.
A Qatar Living guide, last updated in September 2026, sets out what happens next and what it costs:
Priority matters if you have already filed abroad. MOCI's guidance says a Qatar filing that claims priority must be made within six months of the original application.
Qatar participates in WIPO's Madrid System, so a Qatari company can extend its mark to other member countries through one international application, and foreign companies can designate Qatar. WIPO set Qatar's individual fee at CHF 984 per class for an application or subsequent designation and CHF 765 per class for renewal, effective 9 November 2025. A Madrid registration is a bundle of national rights, not a single worldwide trademark: each designated office examines it under its own law.
Under Law No. 7 of 2002 on the Protection of Copyright and Related Rights, protection does not depend on registration. The law states that failure to deposit a work "shall have no effect on its protection." Computer programs are listed as protected works, and databases are protected where their selection or arrangement is creative. Economic rights generally last for the author's life plus 50 years.
Deposit is still useful because a deposit certificate is evidence of what you created and when. In April 2026 MOCI launched five copyright e-services, bringing its digital IP services to seven: applying for a copyright and neighbouring rights deposit certificate, obtaining the certificate, amending a registration, waiving a deposit certificate and obtaining a "to whom it may concern" certificate. MEA Tech Watch notes that they are aimed at rights holders including software developers, authors and architects. For a software startup, depositing major releases is a low-cost way to build a paper trail.
The provision founders most need to know is Article 8: any transfer of economic rights must be in writing and must specify each right transferred, along with its scope, purpose, duration and place. The law has no general rule that work made by an employee or contractor automatically belongs to the company. Get contracts right from the start (see the mistakes below).
Patents are governed by Decree-Law No. 30 of 2006. According to the same Qatar Living guide, an invention must be new, inventive and industrially applicable. Computer programs as such, scientific theories, mathematical methods and some medical methods are excluded. A patent lasts 20 years. Under fees set by Ministerial Decision No. 60 of 2024, which applied reduced fees from 11 July 2024, the guide lists:
The guide gives an indicative processing time of 60 to 72 months. Budget for annual fees across the patent's life, not just the filing cost.
Timing matters more than cost. As general guidance from the European Commission's IP Helpdesk puts it, "any disclosure can, so to speak, kill the novelty of the invention." Once you file, you generally have 12 months to claim priority abroad, and the PCT route lets you delay country choices until about 30 months from that first filing.
Qatar National Vision 2030 calls for a knowledge-based economy, and registered IP is one of the clearest signs of one. Our article on the Global Innovation Index 2026 looked at the gap between Qatar's innovation inputs and outputs. Trademarks, patents and registered creative works are part of what closes it. For individual companies, owned and documented IP makes the business easier to value, license and sell, which supports the scale-up goals of Startup Qatar and NDS3.
